1. Service description

FireFeed (the "Service") is a marketplace feed and order management platform that helps online merchants synchronize product catalogs, inventory, prices and Amazon orders, and operate shipment workflows. The Service is provided by Fire Feed S.r.l. (the "Provider"), an Italian Innovative Start-up and Società Benefit — VAT 18446391007, registered office: Via della Conciliazione 44, 00193 Roma (RM), Italy.

2. Customer responsibilities

The customer (the "Customer") is responsible for:

  • maintaining accurate account information;
  • protecting access credentials to the Service;
  • ensuring that the use of the Service is consistent with applicable laws, including consumer, e-commerce, marketplace and data protection laws;
  • holding all rights necessary to upload product, order and shipping data into the Service.

3. Amazon authorization

Where the Service is connected to an Amazon Seller Central account, the Customer authorizes FireFeed to access SP-API resources via Amazon's authorization mechanism. The authorization is granted by the Customer directly on Amazon, and can be revoked by the Customer at any time from Seller Central. Use of Amazon Information by FireFeed is governed by the Amazon Data Protection Policy and Amazon's applicable terms.

4. Permitted use

The Customer may use the Service for the operation of its own marketplace business and authorized seller accounts. The Customer may not:

  • use the Service to violate the rights of third parties or Amazon's policies;
  • attempt to gain unauthorized access to the Service or to other customers' data;
  • reverse engineer the Service except to the extent permitted by mandatory law;
  • use the Service to send unsolicited communications.

5. Availability

The Provider targets high availability for the Service. Specific service-level commitments, where applicable, are defined in the order form or applicable schedule. The Service may be subject to scheduled maintenance, with reasonable advance notice where practicable.

6. Support

Support is provided in line with the plan purchased by the Customer. Contact channels are listed on the Support page.

7. Suspension

The Provider may suspend access to the Service in case of non-payment, material breach of these terms, or where required to protect the Service, the Customer or third parties (including in response to security incidents).

8. Confidentiality

Each party agrees to protect the confidential information received from the other party with at least the same degree of care it uses for its own confidential information of similar sensitivity, and to use such information only for the purpose of operating or receiving the Service.

9. Data protection

The processing of personal data is governed by the Privacy Policy and, for Amazon Information, the Amazon Data Protection Policy. Where the Provider acts as a processor on behalf of the Customer, a separate data processing agreement applies.

10. Liability

To the maximum extent permitted by applicable law, the Provider's aggregate liability arising out of or in connection with the Service is limited as set out in the order form or applicable schedule. Neither party is liable for indirect, special, incidental or consequential damages, including loss of profits or loss of data, beyond what is expressly agreed.

11. Term and termination

The term of the engagement is set out in the order form. Either party may terminate for material, uncured breach by the other party. On termination, the Provider returns or deletes Customer data in line with the agreed retention and the Amazon Data Protection Policy.

12. Governing law

These terms are governed by the laws of Italy. Disputes arising out of or in connection with these terms are subject to the exclusive jurisdiction of the competent courts of Italy, except where mandatory law provides otherwise.
